Introductory provisions
This Policy establishes a responsible and transparent framework for ensuring compliance with the General Regulation on Personal Data Protection.
The policy applies to all organizational units of “ADRIJAPROSTOR d.o.o.” and all employees, including honorary and temporary workers, as well as all external associates acting on behalf of the processing manager.
Policy statement
The manager of the processing is committed to doing business in accordance with all laws, regulations and the highest standards of ethical business.
This policy sets forth the provisions of the anticipated retention of the employee of the processing manager and his / her external associates engaged in the collection, use, storage, transmission, disclosure or destruction of any personal data belonging to the employees, business partners of the processing manager and other physical persons. The purpose of the policy is to standardize the protection of the rights and freedoms of the respondents by preserving the privacy of their personal data in all aspects of business management operations that include personal information. This policy determines that COURSE MANAGER will not disclose personal information to third parties or act in a manner that threatens them.
Principles of personal data processing
The Manager of Processing adopts the following principles to be followed when collecting, using, retaining, transmitting and destroying personal data:
LEGITIMATE, RIGHTS AND TRANSPARENCY
Personal data will be processed legitimately, fairly and transparently against the respondent. This means that the manager of processing in all relevant situations will inform the respondent on how to process the data (transparency) and processing will take place solely in accordance with (fairness) and in accordance with the purpose stipulated in the applicable law on protection personal data (legitimacy).
LIMITATION OF WRONG
Personal data will be collected for clearly defined and legitimate purposes and will not be processed in any manner that is not in accordance with these purposes. This means that the processing manager must clearly state what data collected will be used and limit the process of processing personal data to the only processes that are required to achieve those purposes.
MINIMIZATION OF DATA
Collected personal data will be relevant and limited to what is necessary to achieve the purpose of their processing. This means that the handler will not collect, process or store more personal data than is necessary.
DATA ACCURACY
Collected personal information will be accurate and up-to-date, which means that the handler will have developed procedures for detecting and solving obsolete, inaccurate and unnecessary personal data.
WARNING POINT OF DATA
Personal data will not be kept in a form that allows the identification of the respondent for longer than is necessary for the purpose of processing. This means that the manager of the processing will keep the personal data wherever possible, in a way that limits or prevents the identification of the respondent.
DATA SECURITY
Personal data will be processed and stored in a manner that ensures adequate protection from injuries such as unauthorized and unlawful processing and accidental loss, destruction or damage to the data. The Processing Manager will implement the appropriate technological and organizational measures described in the Personal Data Security Policy to ensure the integrity and confidentiality of personal data at any time.
PRIVACY CONNECTED TO DESIGN SYSTEM
When designing new ones and reviewing and extending the existing systems and process management, care will be taken to apply all these principles in order to maximize the privacy of the respondent.
The rights of the respondent
All respondents whose data is collected and processed by the processing manager have the following rights:
THE RIGHT TO ACCESS INFORMATION
Each respondent has the right to a copy of the data that the master of the processing has in his archive for the purpose of insight. In addition to the right to inspect your own data,

All information to the respondent should be provided in clear and simple language to ensure understanding and must be clearly indicated and visible as the respondent should not overlook.
There is a possibility that providing the requested information to the respondent may reveal information about another person. In such cases, this information should be anonymised or completely denied in order to protect the rights of that person.
RIGHT TO DATA REVIEW
Each respondent has the right to correct inaccurate or incomplete information that the processing manager has in his / her archive.
THE RULE OF FAILURE
Respondents may request that data be removed from the archive. The request will be taken into consideration and will be met if it does not object to the legal basis for the processing of personal data.
THE RIGHT TO LIMIT THE PROCESS
Respondents have the right to limit the scope of processing, where applicable.
THE RIGHT TO TRANSMIT THE DATA
Respondents are entitled to a copy of the data for transfer to another processing manager.
THE RIGHT OF COMPLAINT
Respondents have the right to complain, especially if the processing is based on the legitimate interest of the processing manager. Then it is necessary to revise the purpose of the processing and to establish its legal basis and, where applicable, to allow the respondent to withdraw data processing privileges and / or terminate processing of his data.
RIGHT TO ASSESS:
Respondents have the right to ask the supervisory authority to assess the violation of the provisions of the Regulation and the internal policies of the processing manager.
THE RIGHT TO APPLY TO PROFILING
Respondents have the right to complain about automatic profiling and other forms of automated decision-making.
In case the processing manager refuses the respondent’s request, the response will include the reason for the refusal, which the respondents may complain to the competent authority for the protection of personal data (AZOP).

The legal basis for the collection and processing of personal data of the respondents is as follows:
LEGAL OBLIGATION
Laws regulating the business of taxpayers prescribe data sets that are necessary for the fulfillment of the legal obligation. For the collection and processing of data prescribed by the law, the processing manager will not ask for the privilege of the respondents, but will only collect data prescribed by law and will not use them for other purposes. LEGITIMATE INTERESTS
The Processing Manager will publish a list of legitimate interests on the basis of which it collects and processes personal data for the purpose of enabling and / or enhancing its services or products.
PROTECTION OF VITAL INTERESTS OF ISPITANTS
The processing manager may collect and process personal data without the consent of the respondent if it is to protect his or her vital interests.
PUBLIC INTERESTS OR EXECUTION OF OFFICIAL OFFICERS OF THE DEVELOPMENT COORDINATOR:
Where the activity of a processing manager involves action on behalf of the public interest or the processing of data is based on another type of official authority, it is not always necessary to inform the interviewee about the collection of personal data.

GENERAL PERSONAL DATA PROTECTION AGREEMENT (GDPR)

Ova Politika utvrđuje odgovoran i transparentan okvir za osiguravanje usklađenosti s Općom uredbom o zaštiti osobnih podataka. Politika se primjenjuje na sve organizacijske dijelove “ADRIJAPROSTOR d.o.o.” (u daljnjem tekstu VODITELJ OBRADE) te na sve zaposlenike, uključujući honorarne djelatnike i privremene radnike jednako kao i na sve vanjske suradnike koji djeluju u ime voditelja obrade.
Voditelj obrade posvećen je poslovanju u skladu sa svim zakonima, regulativama te najvišim standardima etičnog poslovanja. Ova politika iznosi odredbe očekivanog ophođenja zaposlenika voditelja obrade i njegovih vanjskih suradnika koji se bave prikupljanjem, upotrebom, čuvanjem, prijenosom, objavljivanjem ili uništavanjem bilo kakvih osobnih podataka koji pripadaju zaposlenicima, poslovnim partnerima voditelja obrade i drugim fizičkim osobama. Svrha politike je standardizacija zaštite prava i sloboda ispitanika očuvanjem privatnosti njegovih osobnih podataka u svim aspektima poslovanja voditelja obrade koji uključuju osobne podatke. Ovom politikom utvrđuje se da VODITELJ OBRADE neće neovlašteno otkrivati osobne podatke trećoj strani, niti postupati na način koji ih ugrožava.
Voditelj obrade usvaja sljedeća načela kojih ce se držati pri prikupljanju, korištenju, zadržavanju, prijenosu i uništavanju osobnih podataka:
Osobni podaci obrađivat ce se legitimno, pravedno i transparentno spram ispitanika. To znaci da ce voditelj obrade u svim relevantnim situacijama izvijestiti ispitanika o tome kako ce obrađivati podatke (transparentnost), a obrada ce se vršiti isključivo u skladu s time što je rečeno (pravednost) i u skladu sa svrhom koja je propisana u primjenjivom zakonu o zaštiti osobnih podataka (legitimnost).
Osobni podaci prikupljat ce se za jasno definirane i legitimne svrhe te se neće obrađivati ni na koji način koji nije u skladu s tim svrhama. To znaci da voditelj obrade mora jasno navesti za što ce se koristiti prikupljeni podaci te ograničiti procese obrade osobnih podataka na isključivo one procese koji su potrebni da bi se ostvarile te svrhe.
Prikupljeni osobni podaci bit ce relevantni i ograničeni na ono što je nužno za postizanje svrhe njihove obrade. To znaci da voditelj obrade neće prikupljati, obrađivati ni pohranjivati više osobnih podataka no što je nužno potrebno.
Prikupljeni osobni podaci bit ce točni i ažurni, što znaci da ce voditelj obrade imati razvijene procedure za otkrivanje i rješavanje zastarjelih, netočnih i nepotrebnih osobnih podataka.
Osobni podaci neće se čuvati u obliku koji omogućava identifikaciju ispitanika dulje no što je to potrebno za svrhu obrade. To znaci da ce voditelj obrade, gdje god je to moguće, čuvati osobne podatke na način koji ograničava ili sprečava identifikaciju ispitanika.
Osobni podaci ce se obrađivati i pohranjivati na način koji osigurava odgovarajuću zaštitu od povreda poput neovlaštene i nezakonite obrade te slučajnog gubitka, uništenja ili oštećenja podataka. Voditelj obrade ce implementirati prikladne tehnološke i organizacijske mjere opisane u Politici sigurnosti osobnih podataka kako bi u svakom trenutku osigurao cjelovitost i povjerljivost osobnih podataka.
Prilikom dizajniranja novih te pri pregledu i proširenju postojećih sustava i procesa voditelja obrade, vodit ce se briga o primjeni svih ovih načela kako bi se maksimalno zaštitila privatnost ispitanika.
Svi ispitanici čiji se podaci prikupljaju i obrađuju od strane voditelja obrade, imaju sljedeća prava:
Svaki ispitanik ima pravo na kopiju podataka koje voditelj obrade posjeduje u svojoj arhivi u svrhu uvida. Osim prava na uvid u vlastite podatke, ispitanik ima i pravo na informaciju o:
Sve informacije ispitaniku trebaju biti dostavljene jasnim i jednostavnim jezikom, kako bi osigurali razumijevanje, te moraju biti jasno naznačene i vidljive kako ih ispitanik ne bi previdio. Postoji mogućnost da pružanje zatraženih informacija ispitaniku može otkriti informacije o drugoj osobi. U takvim je slučajevima potrebno te podatke anonimizirati ili posve uskratiti kako bi se zaštitila prava te osobe.
Svaki ispitanik ima pravo na ispravak netočnih ili nepotpunih podataka koje voditelj obrade posjeduje u svojoj arhivi.
Ispitanici mogu zatražiti da se podaci o njima uklone iz arhive. Zahtjev ce biti uzet na razmatranje i bit ce mu udovoljeno ukoliko se ne protivi pravnoj osnovi obrade osobnih podataka.
Ispitanici imaju pravo na ograničavanje opsega obrade, u slučajevima u kojima je to primjenjivo.
Ispitanici imaju pravo na kopiju podataka radi prijenosa drugom voditelju obrade.
Ispitanici imaju pravo na prigovor, posebno u slučaju kad se obrada temelji na legitimnom interesu voditelja obrade. Tada je potrebno napraviti reviziju svrhe obrade i ustanoviti njenu pravnu osnovu te u slučajevima kada je to primjenjivo, omogućiti ispitaniku povlačenje privole za obradu podataka i/ili prestanak obrade njegovih podataka.
Ispitanici imaju pravo tražiti od nadzornog tijela procjenu kršenja odredbi Uredbe i internih politika voditelja obrade.
Ispitanici imaju pravo na prigovor na automatsko profiliranje i druge oblike automatiziranog donošenja odluka. U slučaju da voditelj obrade odbije zahtjev ispitanika, u odgovoru ce biti naveden razlog odbijanja, na kojeg se ispitanici mogu žaliti nadležnom tijelu za zaštitu osobnih podataka (AZOP-u).
Pravne osnove za prikupljanje i obradu osobnih podataka ispitanika su sljedeće:
Zakoni kojima se uređuje poslovanje obveznika propisuju skupove podataka koji su nužni za izvršenje zakonske obveze. Za prikupljanje i obradu podataka propisanih zakonima, voditelj obrade neće tražiti privolu od ispitanika, ali ce prikupljati samo podatke propisane zakonom i neće ih koristiti u druge svrhe. Ovo se posebno odnosi na podatke prikupljene temeljem sljedećih zakona i njima pripadajućih pravilnika među kojima izdvajamo:
Osobne podatke potrebne za ispunjenje ugovorne obveze voditelj obrade ce prikupljati bez privole ispitanika, u minimalnom obimu koji je nužan za izvršenje obveze.
Voditelj obrade u daljnjem ce tekstu objaviti popis svojih legitimnih interesa na temelju kojih prikuplja i obraðuje osobne podatke u svrhu omogućavanja i/ili unapređenja svojih usluga ili proizvoda.
Voditelj obrade može prikupljati i obrađivati osobne podatke bez privole ispitanika ukoliko je to u svrhu zaštite njegovih vitalnih interesa.
U slučaju kada djelatnost voditelja obrade obuhvaća djelovanje u ime javnog interesa ili se obrada podataka temelji na drugoj vrsti službene ovlasti, nije uvijek nužno obavijestiti ispitanika o prikupljanju osobnih podataka.
U svim ostalim slučajevima, voditelj obrade tražit ce privolu od ispitanika za prikupljanje i obradu osobnih podataka u kojoj ce svrha obrade biti jasno navedena. Ispitanik u svakom trenutku može povuci privolu i time njegovi podaci moraju automatski biti uklonjeni i obrada prekinuta. Voditelj obrade vodit ce evidenciju aktivnih i povučenih privola u svrhu osiguravanja ispravnosti poslovanja.
Voditelj obrade objavljuje slijedeće legitimne interese:
Ispitanici imaju pravo na prigovor na obrade osobnih podataka koje se temelje na ovim legitimnim interesima.
Opća uredba o zaštiti osobnih podataka (GDPR) (Regulation (EU) 2016/679) je uredba kojom Europski parlament, Vijece Europske unije i Europska komisija namjeravaju ojačati i objediniti procese zaštite osobnih podataka svih pojedinaca unutar Europske unije (EU). Uredba se također odnosi na iznošenje osobnih podataka van EU.
Subjekt koji utvrđuje svrhu, uvjete i način obrade osobnih podataka.
Subjekt koji provodi obradu podataka u ime voditelja obrade.
Državna agencija čiji je zadatak štititi podatke i privatnost, nadgledati procese primjene Uredbe, te aktivno provoditi Uredbu o zaštiti osobnih podataka unutar Europske unije.

Bilo koja informacija koja se dovodi u vezu s fizičkom osobom, tj. ispitanikom i koja se može koristiti za izravno ili neizravno identificiranje osobe.
Bilo koja djelatnost koja se provodi nad osobnim podacima, automatska ili ne, koja uključuje prikupljanje, upotrebu, izradu zapisa i slično.
Svaka automatizirana obrada podataka u svrhu procjene, analize ili predviđanja ponašanja ispitanika.
Poznato kao ‘pravo pristupa’, omogućuje ispitaniku pristup osobnim podacima koji ga se tiču i koji su u posjedu voditelja obrade.
